1.2 Cookie Confirm: The software platform for managing user consent and data, accessible via https://cookieconfirm.com.

1.3 Client: Any individual or legal entity using Cookie Confirm.

1.4 Service: The subscription-based access and use of Cookie Confirm provided to the Client.

1.5 User license: A non-exclusive, non-transferable right to use Cookie Confirm.

Article 2 – Applicability

2.1 These terms apply to all offers, agreements, and use of Cookie Confirm.

2.2 Deviations are only valid if confirmed in writing by Hashtag SEM Marketing Management FZCO.

Article 3 – Terms of use

3.1 Cookie Confirm is provided “as is”. Features are determined by the current version available at https://cookieconfirm.com.

3.2 The Client is granted a non-exclusive, non-transferable license to use the software.

3.3 Hashtag SEM Marketing Management FZCO reserves the right to modify, add, or discontinue features at any time without prior notice.

Article 4 – Liability

4.1 Hashtag SEM Marketing Management FZCO is not liable for any legal, financial, or operational consequences resulting from the use of Cookie Confirm.

4.2 No guarantees are made regarding compliance with laws or regulations, including the GDPR.

4.3 Any tips, advice, or instructions provided are for informational purposes only and do not constitute legal advice.

Article 5 – Client responsibilities

5.1 The Client remains fully responsible for:

• Compliance with applicable data protection laws (e.g., GDPR).
• Proper implementation and configuration of Cookie Confirm.
• Managing account access and ensuring secure password practices.
• Indicating which pages must be scanned.

5.2 The Client is solely responsible for the accuracy of cookie descriptions shown on their website. Automatically generated texts from Cookie Confirm are not legally binding.

Article 6 – Consent log

6.1 The consent log includes partial IP address, user agent, country, consent status, and whether consent was explicit or implicit.

6.2 This data is stored for up to one year unless agreed otherwise. Data may be archived in less accessible storage during this period.

Article 7 – Payment and subscription

7.1 Payment is processed via third-party payment providers and may be monthly, annually, or per other agreed terms.

7.2 Late payments may result in temporary suspension of service.

7.3 Subscriptions can be canceled by either party on a monthly basis unless otherwise agreed.

Article 8 – Misuse and termination

8.1 Hashtag SEM Marketing Management FZCO may terminate service without refund in the event of:

• Misuse of the software, API, or infrastructure.
• Use by businesses in prohibited industries (e.g., weapons, gambling, adult content, hate/discrimination).

8.2 Determination of misuse is at the sole discretion of Hashtag SEM Marketing Management FZCO.

Article 9 – Confidentiality and security

9.1 Reasonable efforts will be made to treat client data confidentially and implement appropriate security measures.

9.2 Clients are responsible for protecting their own accounts. Hashtag SEM Marketing Management FZCO is not responsible for unauthorized access due to client negligence.

Article 10 – Fair use policy

10.1 Excessive use of resources (e.g., server load, API calls) may result in limitations or additional charges, as determined by Hashtag SEM Marketing Management FZCO.

Article 11 – Force majeure

11.1 The company is not liable for disruptions caused by events beyond its control, such as outages, cyberattacks, changes in law, or natural disasters.

Article 12 – Termination and data deletion

12.1 Upon termination, website data will be deleted from active systems within 30 days unless legal obligations require retention. Clients are responsible for exporting their data prior to termination.

Article 13 – Support and service level

13.1 Support is available via email (support@cookieconfirm.com) and live chat during regular business hours. Responses are typically provided within two business days, but no specific resolution timeframe is guaranteed.

Article 14 – Updates and migrations

14.1 Hashtag SEM Marketing Management FZCO may perform updates or migrations at any time. Clients are expected to cooperate where necessary. Temporary interruptions caused by updates do not entitle the Client to compensation.

Article 15 – Communication

15.1 All official communication will be sent to the Client’s registered email address and from support@cookieconfirm.com. The Client must notify the company of any changes to their contact information.

Article 16 – Intellectual property

16.1 All intellectual property rights related to Cookie Confirm remain with Hashtag SEM Marketing Management FZCO.

16.2 Texts entered into Cookie Confirm by the Client are not copyrighted and may be reused by Hashtag SEM Marketing Management FZCO.

Article 17 – Refund policy

17.1 New Clients are entitled to a full refund within 14 days of their initial subscription purchase, provided they have not made excessive use of the service during that time.

17.2 Refund requests must be submitted in writing via support@cookieconfirm.com within the 14-day window.

17.3 No refunds will be granted after this period, or for renewal payments.

17.4 Hashtag SEM Marketing Management FZCO reserves the right to deny refunds in cases of abuse or misuse of the platform.
